Temporary Orders in Divorce Cases

Divorce proceedings can take longer than anticipated depending on the specific facts of your case. However, there are some aspects of the proceedings that require immediate relief, and temporary orders provide this relief. Temporary orders can protect you, your children, or your property while the divorce is pending.

Parties in divorce proceedings can request temporary orders that require one parent to pay child support or lay out a child custody arrangement. Additionally, the parties can ask for temporary restraining orders that prevent one spouse from doing something, such as canceling insurance or hiding assets. Further, ex parte temporary orders are granted to one party without giving the other party notice or time to respond. The non-requesting party will be given 14 days to respond or set a hearing, and if not, the ex parte order becomes a temporary order. Ultimately, temporary orders can help alleviate strain on divorce proceedings and keep things as amicable as possible.
